You agree not to use this website for unlawful, harmful, misleading, abusive, or unauthorized purposes. You also agree not to interfere with website functionality, attempt to gain unauthorized access, copy website content without permission, or use the website in a way that may damage Winmax, its systems, or other users.
We may update, modify, remove, or replace website content at any time without notice.
3. Quotes and Estimates
Quotes, estimates, pricing discussions, website pricing examples, and verbal pricing guidance are provided for informational and planning purposes unless confirmed in a written quote or project agreement.
All quotes provided by Winmax:
- Are based on the information available at the time
- May depend on final measurements and site inspection
- May change if project details, site conditions, product selections, or installation requirements change
- Are valid only for the period stated in the quote, if a validity period is provided
- Are subject to product availability, supplier pricing, and project approval
Final pricing may vary based on window or door size, style, colour, glass package, hardware, installation method, finishing work, accessibility, structural conditions, additional labour, or other project-specific factors.
4. Measurements and Site Conditions
Accurate measurements and proper assessment of site conditions are essential for window and door replacement projects. Final product sizing, installation method, and pricing may depend on a professional measurement or site visit.
Site conditions may include:
- Existing frame condition
- Wall, brick, siding, stucco, or exterior finish conditions
- Interior trim and finishing details
- Structural conditions
- Moisture, rot, or damage around openings
- Accessibility and safety considerations
- Electrical, alarm, blind, security, or other attached systems
- Hidden conditions discovered after work begins
If hidden or unexpected conditions are discovered, additional work, cost, time, materials, or changes to the project scope may be required.
5. Orders and Payments
Orders are confirmed only after the customer accepts the quote or project agreement and provides any required deposit, payment, or written approval.
Payment terms will be outlined in your quote, invoice, order confirmation, or project agreement. Unless otherwise stated in writing, payment is required according to the agreed project schedule.
Failure to meet payment terms may result in project delay, suspension, cancellation, collection activity, or other remedies available under the agreement and applicable law.
Deposits and payments may be used for ordering products, reserving installation time, preparing materials, project administration, and related project costs.
6. Product Availability
Product availability, specifications, colours, glass options, hardware, accessories, manufacturing timelines, and supplier details may change without notice.
If a selected product, colour, glass option, hardware item, or accessory becomes unavailable, delayed, discontinued, or changed by a supplier or manufacturer, Winmax may recommend a suitable alternative. Any material change to the project may require customer approval.
7. Installation and Scheduling
Installation dates are scheduled based on product delivery, crew availability, site readiness, weather conditions, customer availability, and project complexity.
Winmax will make reasonable efforts to complete projects on time. However, delays may occur due to factors beyond our control, including:
- Weather conditions
- Supplier or manufacturer delays
- Shipping or delivery delays
- Product backorders
- Hidden site conditions
- Customer-requested changes
- Permit or inspection delays
- Safety concerns
- Events beyond reasonable control
Installation work may be rescheduled if weather, safety, access, site conditions, or other circumstances make it unreasonable or unsafe to proceed.
8. Customer Responsibilities
Customers are responsible for providing accurate project information and reasonable access to the property before and during installation.
Customer responsibilities may include:
- Providing accurate contact and project details
- Ensuring safe and reasonable access to the property
- Clearing furniture, blinds, curtains, valuables, or personal items near work areas
- Removing or securing pets during appointments and installation
- Informing Winmax about special conditions, restrictions, alarms, wiring, plumbing, or hidden systems
- Obtaining required approvals from property owners, condo boards, homeowner associations, or other decision-makers where applicable
- Ensuring an authorized adult is available when required
- Reviewing and approving project details before products are ordered
Failure to prepare the site or provide required access may result in delays, rescheduling, additional charges, or cancellation of the appointment or project.
9. Changes and Cancellations
Customer-requested changes to products, measurements, colours, glass packages, hardware, installation method, scheduling, or project scope must be reviewed and approved by Winmax.
Changes may affect pricing, product availability, manufacturing timelines, installation dates, warranty coverage, and project completion.
Because many window and door products are custom-made or ordered specifically for a project, cancellations after order confirmation may be subject to charges, deposit retention, restocking fees, manufacturer charges, or other costs already incurred.
Any cancellation terms in a written quote, invoice, order confirmation, or project agreement will apply.
10. Permits and Code Compliance
Some projects may require permits, inspections, engineering review, condo approval, homeowner association approval, or other authorization. Permit requirements can vary depending on project scope, property type, structural changes, egress requirements, basement development, exterior modifications, and local rules.
Unless otherwise stated in writing, the customer is responsible for confirming and obtaining any required permits, approvals, or authorizations before work begins.
Winmax may provide general information about common project considerations, but we do not guarantee that a project does or does not require a permit unless this is specifically confirmed in writing as part of the project scope.
11. Product Information
Product descriptions, images, colours, finishes, diagrams, performance details, technical information, and website content are provided for general informational purposes.
Actual products may vary from website images or samples because of manufacturing differences, lighting, screen settings, product updates, supplier changes, installation conditions, and selected options.
Product specifications, features, glass packages, hardware, colours, dimensions, and availability may change without notice.
12. Warranty
Warranty coverage varies depending on the product, manufacturer, installation scope, project type, and written warranty terms provided with your purchase.
Specific warranty information will be provided in the applicable quote, invoice, order confirmation, manufacturer warranty, installation warranty, or project documentation.
Warranty coverage may be subject to conditions, exclusions, limitations, maintenance requirements, transferability rules, claim procedures, and manufacturer terms.
Warranty coverage may not apply to issues caused by improper use, lack of maintenance, customer modifications, third-party work, building movement, structural problems, condensation caused by indoor humidity, abuse, accidental damage, extreme events, or conditions outside the product or installation warranty terms.
13. Maintenance and Use
Customers are responsible for reasonable care, operation, and maintenance of installed windows, doors, glass, screens, hardware, locks, weatherstripping, finishes, and related components.
Proper maintenance may include cleaning tracks, checking hardware, managing indoor humidity, keeping drainage paths clear, protecting finishes, and following manufacturer care instructions.
Improper use, lack of maintenance, unauthorized repairs, or modifications by others may affect performance and warranty coverage.
14. Third-Party Services and Materials
Winmax may work with suppliers, manufacturers, installers, contractors, delivery providers, technology providers, or other third parties to provide products and services.
Some products, components, warranties, timelines, or service obligations may be controlled by third-party manufacturers or suppliers. Winmax is not responsible for delays, changes, discontinued products, manufacturer decisions, or third-party actions beyond our reasonable control.
15. Limitation of Liability
To the fullest extent permitted by applicable law, Winmax will not be liable for indirect, incidental, special, punitive, consequential, or economic damages, including loss of use, loss of profits, business interruption, or delays caused by suppliers, manufacturers, weather, site conditions, or other circumstances beyond our reasonable control.
Our liability, where applicable, is limited to the value of the specific products or services provided by Winmax for the project giving rise to the claim, unless otherwise required by law or stated in a written agreement.
Nothing in these Terms and Conditions is intended to limit or exclude any rights, remedies, or protections that cannot be limited or excluded under applicable law.
16. Intellectual Property
All website content, including text, images, layouts, graphics, branding, logos, service descriptions, and other materials, is owned by Winmax or used with permission unless otherwise stated.

19. Changes to These Terms
Winmax may update these Terms and Conditions from time to time to reflect changes in our services, website, business practices, legal obligations, or project procedures.
